  • ICE Trade Vault Europe Ltd (ICE TVEL), based in the United Kingdom; and
  • CME Trade Repository Ltd (CME TR), based in the United Kingdom.

We almost forgot due to the EMIRate frenzy. But another company, this time from Austria, has decided to use TFM for their group-wide cash reporting and cash flow forecasting.

ESMA appoints four repositories, reporting to start on February 12, 2014

ESMA today appointed four Trade Repositories.

  • DTCC Derivatives Repository Ltd. (DDRL), based in the United Kingdom;
  • Krajowy Depozyt Papierów Wartosciowych S.A. (KDPW), based in Poland;
  • Regis-TR S.A., based in Luxembourg; and
  • UnaVista Ltd, based in the United Kingdom.

The reporting obligation will start on February 12, 2014.

We recently heard from a couple of companies that they had been told that simple forward contracts do not have to be reported. Please do not believe everything that you hear, forwards of course have to be reported as well (this is EMIR, not DF). EMIR & Financial Instruments

Did you know which financial instruments have to be reported under EMIR? The EU Directive 32004L0039 (EUR-lex 32004L0039) is an integral part of EMIR and defines 'financial instruments'.

The full list of instruments can be found in Annex 1, Section C - it contains, among others, derivative contracts relating to climatic variables, freight rates, emission allowances. This means that e.g. forward freight agreements or emission certificates will have to be reported under EMIR as well.
